Terms and Conditions of Use for Detecto

Welcome to Detecto!

 

By downloading, accessing, or playing Detecto (the "Game"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our Game. If you do not agree to these Terms, do not use the Game.

 

1. General Information

2. Free to Play

- Detecto is completely free to play. Players will never be expected to use real money in order to win cash prizes.

- Players use tokens to enter games. Tokens are obtained for free each day through the Game and through watching ads only. They cannot be purchased or exchanged.

 

3. Cash Prizes

- Detecto is a skill-based game that requires players to accurately determine the subject of a given photo as fast as possible. All games are free to enter and will never require any form of payment away from free, in-game tokens. Detecto, under UK law, is therefore NOT a form of gambling.

- Cash prizes are allocated to the top-ranked players on the daily leaderboard, based on the fastest average time achieved. For details on what prizes are available, please view the “Rewards” screen within the “Leaderboards” section of the Game.

- Cash prizes are only sent via PayPal at the moment (subject to change in the future) and only to those players who have entered a valid PayPal email address.

- Cash prizes must be claimed within 30 days. Failure to claim will result in the prize being forfeited.

- Cash prizes are sent in GBP and may be subject to international exchange fees via PayPal. Please see PayPal’s terms for more information.

 

4. Fair Play and Cheating

- We have designed Detecto to be a completely free-to-play game, with no advantage obtained through monetary spend. This ensures an even playing field for all players and no chance of a “pay-to-win” scenario.

- Cheating or manipulating the Game in any way to gain an unfair advantage over other players or to secure prizes that would otherwise not be due to you will result in your account being permanently banned.

- Examples of cheating include, but are not limited to, using automated software or bots, exploiting bugs, and sharing accounts.

 

5. Use of Player Information

- Detecto does not use player information such as name, email address, physical address, or PayPal address for any purpose beyond those relevant to awarding cash prizes.

- We will never use, sell, or distribute player information for any reason whatsoever, away from notifying players of their winnings.

 

6. Account Registration and Security

- Players are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

- Players must notify Detecto immediately of any unauthorised use of their account or any other breach of security.

 

7. Age Restrictions

- Detecto has an age rating of 12+. If you are under 18 years old, you must have your parent or guardian’s permission to use the Game. Subject to your local laws and regulations, players under 18 years of age may need parental permission to claim cash winnings.

 

In the UK, the rules surrounding minors (under 18) entering competitions where they can win small amounts of money are nuanced and depend on the specific nature of the competition and the prize. Here are some key points to consider:

 

Free Competitions: Generally, it is legal for minors to enter free competitions as long as they do not require any form of payment to enter. This includes competitions where the prize is money, as long as there is no gambling element involved. Given that Detecto is free to play and involves skill instead of chance, Detecto is not deemed to be a form of gambling.

Gambling Act 2005: According to the Gambling Act 2005, certain types of competitions may be considered as lotteries or gambling if they require payment to enter or if the outcome is determined by chance. Minors are not allowed to participate in gambling activities. Again, given that Detecto is a game of skill, not chance, and requires no payment to enter, playing our game does not constitute a form of gambling.

Prize Competitions and Free Draws: The Gambling Act distinguishes between lotteries, prize competitions, and free draws. Prize competitions and free draws are generally not considered gambling and can be legally entered by minors, provided they do not involve any form of payment to enter.

Parental Consent: For competitions that offer significant prizes, including cash, it's often advisable to seek parental consent for entrants who are minors. This is not a strict legal requirement for all competitions, but it is considered good practice to ensure transparency and parental oversight. We therefore require any players under the age of 18 to seek parental permission to claim any cash prizes. This can be achieved, most simply, by providing the parents’ PayPal address instead of the minor’s.

 

8. Limitation of Liability

- Detecto is provided "as is" without warranty of any kind, either express or implied. Detecto does not warrant that the Game will be uninterrupted or error-free.

- In no event shall Detecto be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of or in connection with your use of the Game.

 

9. Modifications to the Terms

- Detecto reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms. Your continued use of the Game after the posting of the revised Terms constitutes your acceptance of such changes.

   • Some of the photos displayed on our app may depict brand names, logos, or products. These photos are intended to reflect the everyday nuances of life and are not edited in any way. We do not have any affiliation, sponsorship, endorsement, or relationship with the brands or products depicted in these images. The inclusion of these brands or products in our photos is purely incidental and does not imply any connection with the respective trademark owners.

   • Detecto is in no way affiliated nor partnered with Apple, Google or PayPal.

   • Detecto is run and operated in accordance with both Apple's EULA and Google's EULA.

2. Sponsored Materials Disclaimer

   • Detecto may showcase certain photos, videos, and/or products as part of paid partnerships. Any such sponsored content will always be clearly indicated as such within the related content. We maintain transparency to ensure that users are aware of any sponsorships or paid partnerships featured on our app.

 

10. Governing Law

- These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
